FITNESS CLASS PARTICIPATION WAIVER AND RELEASE OF LIABILITY

PLEASE READ CAREFULLY. BY SIGNING BELOW, YOU AGREE TO THE FOLLOWING TERMS. 

This Fitness Class Participation Waiver and Release of Liability (“Agreement”) is entered into by and between the participant (“Participant”) and Harmon y Ellington (“Instructor”), and applies to all classes, workshops, events, and training sessions provided by the Instructor, whether in person or virtual.

1. Assumption of Risk

I acknowledge that participation in physical fitness activities carries inherent risks, including but not limited to: muscle soreness, strain, injury, heart complications, and even death. I voluntarily choose to participate in this activity fully aware of the risks involved and assume all such risks.

2. Health Certification

I certify that I am in good health and physical condition to participate in fitness activities and that I have either:

• Consulted with a physician prior to participation and been cleared to participate, or

• Chosen to participate despite any medical conditions or risks, and accept full responsibility for doing so.

3. Release and Waiver

In consideration of my participation, I hereby release, waive, discharge, and hold harmless the Instructor, the facility, any assistants or employees, and all affiliated parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by me or to my property while participating in any fitness class or activity, including travel to and from such activity.

4. Indemnification

I agree to indemnify and hold harmless the Instructor and all released parties from any claims made as a result of my actions, including those made by other participants, guests, or third parties.

6. No Guarantee of Results

I understand that fitness activities may lead to improvements in physical condition, but no specific results are guaranteed. I take full responsibility for my own progress and commitment.

7. Severability

If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws rules.

9. Kindness, Respect & Community Conduct

I understand that participation in this class is not only physical but communal. I agree to uphold a standard of kindness, respect, and consideration for the instructor, fellow participants, and myself. This includes, but is not limited to:

• Refraining from disruptive, disrespectful, or aggressive behavior

• Not engaging in lewd, harassing, or discriminatory conduct of any kind

• Avoiding any form of body shaming, hate speech, or verbal abuse

I acknowledge that this is a space intended for personal growth, support, and collective well-being. I understand that any behavior deemed inappropriate or harmful by the Instructor may result in immediate dismissal from the class or program without refund. Continued participation is contingent on maintaining a respectful and inclusive environment.
